This Agreement sets forth the terms and conditions governing your use of the OnPoint Abrasives website and the purchase of any products or services ("Products") from OnPoint Abrasives. Orders and Returns
1.1. Order Placement: All orders placed with OnPoint Abrasives are subject to acceptance by OnPoint Abrasives. OnPoint Abrasives reserves the right to refuse any order in its sole discretion.
1.2. Return Policy: OnPoint Abrasives offers a 90-day return policy for Products. If you are not satisfied with your purchase, you may return the Product within 90 days of the purchase date for a refund or exchange, subject to the terms and conditions of our Return Policy.
Pricing and Payment
2.1. Pricing: The prices for the Products are as stated on the OnPoint Abrasives website, unless otherwise specified. OnPoint Abrasives reserves the right to change prices for Products at any time without prior notice.
2.2. Shipping Costs: Shipping costs will be added to the invoice unless otherwise specified on the order. The exact shipping cost will be calculated based on the shipping address and the weight and dimensions of the ordered Products.
2.3. Sales Tax: Orders originating outside of Arizona, USA are exempt from sales tax. If your order is shipped to an address within Arizona, USA, applicable sales tax will be added to the invoice.
Shipping and Delivery
3.1. Shipping Method: OnPoint Abrasives will use commercially reasonable efforts to ship the Products using the shipping method selected by you during the ordering process.
3.2. Delivery Time: OnPoint Abrasives will make reasonable efforts to ensure timely delivery of the Products. However, OnPoint Abrasives does not guarantee specific delivery dates or times.
3.3. Risk of Loss: The risk of loss or damage to the Products passes to you upon delivery of the Products to the carrier. It is your responsibility to inspect the Products upon receipt and promptly report any damage or discrepancies to OnPoint Abrasives.
Intellectual Property
4.1. Ownership: OnPoint Abrasives retains all rights, title, and interest in and to its intellectual property, including but not limited to trademarks, logos, and copyrights.
4.2. Use of Intellectual Property: You may not use, reproduce, distribute, or modify any intellectual property of OnPoint Abrasives without prior written consent.
Limitation of Liability
To the extent permitted by applicable law, OnPoint Abrasives shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with the use or performance of the Products or this Agreement, even if OnPoint Abrasives has been advised of the possibility of such damages.
Governing Law and Jurisdiction
This Agreement shall be governed by and construed in accordance with the laws of the state of Arizona, USA, without regard to its conflicts of laws principles. Any legal action or proceeding arising out of or relating to this Agreement shall be brought exclusively in the federal or state courts located in Arizona, USA.
Entire Agreement
This Agreement constitutes the entire agreement between you and OnPoint Abrasives regarding the subject matter hereof and supersedes all prior or contemporaneous agreements, understandings, and representations, whether oral or written.
By placing an order with OnPoint Abrasives, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.
